These General Terms and Conditions of Sale exclusively govern the commercial relationship with our customers for the sales and services presented on the website www.zeldazang.com.
All orders placed on the Site are subject to these terms and conditions of sale, which are accessible and printable at any time via a direct and permanent link on this site. These terms and conditions are subject to change and updates; the terms and conditions applicable to a customer's order are those in effect on the date the order is placed.
It is understood that individuals legally incapable of entering into contracts under Articles 1123 et seq. of the French Civil Code, particularly unemancipated minors, must obtain the authorization of their legal representative before placing any order. Given the seasonal nature of our business, our product offers are valid while supplies last.

These general terms and conditions of sale are subject to French law, except for mandatory provisions to the contrary such as those arising from the Rome Convention on the law applicable to contractual obligations of 19 June 1980.

Order

You can place an order on our website by selecting the items of your choice, which you will then place in your basket by clicking on the "Add to my basket" button.

The order is only registered after the accuracy of the information provided has been confirmed. This order acceptance becomes final upon receipt of payment by Zelda Zang.

We will acknowledge receipt of your order as soon as possible by sending you an email summarizing your purchases to the email address you provided when confirming your order.
For this purpose, the customer formally accepts the use of email for confirmation by Zelda Zang of the contents of their order.

All items viewable online are available except in the event of an error in our stock management.

Price

Prices are expressed in Euros inclusive of all taxes (TTC) excluding delivery charges.
The VAT included is the French VAT in effect on the day of the order.

The products remain the property of Zelda Zang until full payment of the price.
Zelda Zang reserves the right not to fulfill an order in the event of a legitimate reason as defined by the regulations (dispute relating to a previous order, abnormal request from the customer).

Payment

The price is payable in full by the customer on the day the order is placed.
Payment is made online, at the time of ordering, by Credit Card or PayPal.
VISA and EUROCARD MASTERCARD bank cards are accepted.

The customer must be the cardholder of the bank card used. They access a dedicated space provided by a banking institution.
To ensure payment security, confidential data (16-digit card number, expiry date, visual cryptogram) is transmitted encrypted (encoded) using the SSL security standard.

For customers residing in French overseas departments and territories or outside the European Union, it is specified that the prices displayed on the Site will be charged at the applicable VAT rate.
These prices should be understood as "delivered duty unpaid" (or DDU "Delivery Duty Unpaid"), as ZELDA ZANG is materially unable to provide customers with accurate information on the total amount of fees relating to customs duties and formalities, import taxes applicable in the country where delivery is requested.

The payment of any fees that may be required for the entry of the ordered products into the delivery territory is the sole responsibility of the customers, which they accept.
The customer's refusal to pay customs fees will result in the cancellation of the order and a refund. Any shipping and customs clearance fees paid by ZELDA ZANG to recall the order will be deducted from the refunded amount.

The seller will not be obliged to deliver the products ordered by the customer if the customer does not pay the full price under the conditions indicated above.

Ownership of the products will only transfer from the Seller to the customer after full payment of the price by the latter, regardless of the delivery date of said products.

If you are not home, a notice of pending delivery will be left in your mailbox.

In order for these deadlines to be met, the customer must ensure that they have provided accurate and complete information regarding the delivery address.
The ordered product is delivered by post or by an independent carrier according to your selection when placing the order, to the address appearing on the buyer's order form.

For security reasons, all our shipments are delivered against signature and accompanied by loss/theft insurance.

The Customer will be able to track their package using the tracking number that will be sent to them by email when the order is shipped.

This address may differ from the payer's address.

In the event that the buyer is absent at the time of delivery of the ordered product, it is his responsibility to collect his delivery from the address mentioned by the postmaster or the carrier and according to the terms specified by the latter, on the delivery notice left at the delivery address.
If the delivery is not collected within the period indicated on this notice, the corresponding package will be returned to ZELDA ZANG, who reserves the right to reimburse the buyer as soon as possible, with the delivery and return costs being deducted from the total amount of the order, and to keep the product that the latter had ordered.

The customer is responsible for checking the condition of the delivered products. They have 3 business days from the date of delivery to submit any claims by email to contact@zeldazang.com, including all supporting documentation (photos in particular). After this period, and if these formalities have not been observed, the products will be considered compliant and free from any apparent defects, and no claim will be validly accepted by the Seller.

In the event of non-conformity of the delivered product due to transport conditions noted at the time of delivery, the seller undertakes to remedy the situation or to reimburse the buyer.

In this regard, it is the buyer's responsibility to check the contents, conformity, and condition of the product upon delivery. This verification is deemed to have been carried out once the buyer, or a person authorized by them, has signed the delivery note presented by the postal worker or the carrier.
Delivery times vary depending on your chosen delivery method. These times are estimates, and ZELDA ZANG cannot be held responsible for any delays.
In particular, due to force majeure events such as strikes or bad weather preventing deliveries, there can be no cancellation of the order, no reduction in the price paid by the buyer, and no payment of damages.

Any delay or failure to perform the services provided for herein shall not constitute a fault attributable to ZELDA ZANG, insofar as it can be justified that this delay is due to a case of force majeure as defined by the regulations.

You must carefully check the contents of the package upon receipt and, in case of damage or missing items, be sure to make specific and reasoned reservations on the delivery receipt.
Otherwise, you have a legal period of three (3) days, not including public holidays, from the receipt of the package to make these reservations by registered letter with acknowledgment of receipt directly to the carrier, in accordance with Article L. 133-3 of the Commercial Code.
The jewelry is carefully packaged in a "ZELDA ZANG" pouch.

"Satisfaction guaranteed or your money back" cancellation period

The buyer has a withdrawal period of thirty clear days from the delivery of the product to return it to ZELDA ZANG for a refund, without penalty, with the exception of the outbound and return shipping costs which remain the responsibility of the buyer.

No refunds for products ordered online can be given in any of our stores.

Return address

Furthermore, the buyer agrees to return the item under the same conditions as the original shipment by mail to:

Products returned incomplete, damaged, broken, lacking identification proving that the product has never been worn, deteriorated or soiled by the customer will not be refunded.

The exercise of the right of withdrawal is subject to the buyer sending ZELDA ZANG the delivered product, as well as the buyer's bank details so that the seller can proceed with the refund if the buyer opts for a refund.
Unless expressly stated otherwise by the buyer, the bank details for the refund must be identical to those appearing in the order form validated by the buyer during their initial order.

The costs resulting from this return shipment are to be borne by the buyer, it being specified that the conditions of the shipment and the return must be identical.
Once the buyer has exercised their right of withdrawal within the allotted time, the seller undertakes to reimburse them within a maximum period of 15 working days, the full amount paid, with the exception of delivery costs and return costs referred to above, provided that the delivered product is returned to the seller in its original condition.

Seller's Warranty and Liability

All ZELDA ZANG jewelry comes with a 1-year commercial warranty, starting from the date of receipt of the order, against any manufacturing defects, damaged or defective products, or products not matching the order, and against hidden defects arising from a defect in material, design or manufacturing affecting the delivered products and rendering them unfit for use.

During this period, ZELDA ZANG commits to replacing or repairing any defective parts free of charge. To benefit from the warranty, simply contact the Online Store's Customer Service department by following these steps:

1. Have your order number and the reference of the item in question ready (you will find this information on your purchase invoice in your Customer Area).

To ensure your request is processed quickly and efficiently, please provide your contact details, order number and the name of the model concerned.

We recommend that you describe the problem in as much detail as possible and, if possible, attach a photograph of the product defect to your email.

Upon receipt of your request, the Online Store's Customer Service will contact you as soon as possible to explain the procedure to follow.

Please note that this warranty does not apply to normal wear and tear of the product, excessive use of detergent, or damage due to misuse.

In the event that the requested repair is not covered by the warranty or if the warranty has expired, ZELDA ZANG may offer you (subject to availability of parts) a paid repair.

For all types of repairs, the estimated repair time is 30 days.

Shipments must be made by tracked letter post or tracked Colissimo in order to have traceability of the outbound and return transport.
The customer is responsible for all transportation costs, both to and from the destination.

In accordance with the provisions of the Consumer Code concerning "the mediation process for consumer disputes", the buyer has the right to use the free mediation service offered by ZELDA ZANG.

Applicable law and jurisdiction

Any disputes relating to the interpretation and execution of these Terms of Sale of products shall be subject to the exclusive jurisdiction of the Commercial Court of Marseille.
The applicable law is French law, including the 1980 Vienna Convention on the International Sale of Goods. ZELDA ZANG's registered office is located at 180 Avenue du Prado, 13008 Marseille, France.

Intellectual Property

The website www.zeldazang.com and all its elements are protected by applicable intellectual property rights. They are the exclusive property of ZELDA ZANG. Use of this website is strictly for personal purposes.
Any use, reproduction, exploitation, representation..., in whole or in part and on any medium whatsoever, for purposes other than personal use, is prohibited and subject to criminal penalties, in particular under the heading of counterfeiting.
